This Privacy Policy sets forth the manner in which Vargas Peña Adamek Estudio Jurídico (the “Firm”) collects, uses and safeguards the personal data of those who access and use its website (the “Website”).

The Firm recognizes the importance of the privacy and confidentiality of the information provided by users and is committed to processing personal data in accordance with applicable law and with reasonable security and confidentiality measures.

By voluntarily providing data, including personal data and/or data relating to your company, through the contact form, the “Join us” section or any other contact channel available on the Website, you acknowledge that you have read this Privacy Policy, the current version of which is permanently published on, and accessible from every page of, the Website.

02Personal Data Collected

The Firm may collect the personal data that users voluntarily provide through the Website or the contact channels made available thereon, including, without limitation:

  • first and last name;
  • email address;
  • telephone number;
  • company or organization and position; and
  • any other information that the user voluntarily provides when submitting an inquiry or otherwise communicating with the Firm.

The Website may also collect certain technical information relating to its use, such as IP address, browser type, device used, date and time of access and browsing data, to the extent applicable.

Through the “Join us” section, the Firm may additionally collect the information contained in the applicant’s curriculum vitae, academic background, professional experience, contact details and any other information voluntarily provided in connection with an application.

03Purposes of Processing

The personal data collected may be used by the Firm to:

  • respond to inquiries or requests submitted through the Website;
  • maintain contact with clients, prospective clients and other persons who communicate with the Firm;
  • send communications, legal updates, event invitations or institutional information, where appropriate;
  • receive, manage and evaluate applications submitted through the “Join us” section and contact applicants regarding current or future employment opportunities;
  • administer, maintain and improve the operation and security of the Website; and
  • comply with legal obligations or requests from competent authorities.

Personal data will be used solely for the purposes for which it was collected or for purposes compatible therewith.

04Inquiries Through the Website and Contact Channels

Submitting an inquiry through the contact form, the WhatsApp button, email or any other channel available on the Website does not, in and of itself, create an attorney-client relationship between the user and the Firm, nor does it constitute acceptance of an engagement. Such a relationship is established only when the Firm expressly confirms the engagement in writing, after verifying the absence of conflicts of interest and agreeing on the terms of the engagement.

The contact form and the WhatsApp button on the Website operate through ordinary means of communication (the user’s own email and the WhatsApp messaging application), the security of which is beyond the Firm’s control. Accordingly, until the Firm confirms the engagement, it cannot guarantee the confidentiality of information transmitted through those means, without prejudice to the duty of discretion with which the Firm treats all communications it receives.

Users are advised not to include sensitive personal data, confidential or privileged information, documents or substantive details of the matter in their initial inquiry, and to limit it to a general description that allows the Firm to assess the inquiry and determine the appropriate channel for further communication.

05Sensitive Data

The Firm does not request sensitive personal data, or data relating to criminal, judicial or administrative records, through the Website. Nevertheless, given the nature of legal services, users may voluntarily include information of that kind in their inquiries or applications. In such cases, the Firm will process such data solely to the extent necessary to respond to the inquiry, after verifying the absence of conflicts of interest, or to manage the application, with access restricted to the professionals involved and subject to enhanced security measures, it being understood that, by submitting such data, the user expressly consents to its processing for that purpose.

06Disclosure to Third Parties

The Firm does not sell or otherwise commercialize the personal data it collects.

The Firm may, however, grant access to or disclose such data to providers of technology, web hosting, data storage or other services necessary for the operation of the Website or the conduct of the Firm’s activities, who shall use such data solely for the corresponding purposes.

Personal data may also be disclosed where necessary to comply with a legal obligation, a court or administrative order, or a request from a competent authority.

07International Data Transfers

Certain service providers used by the Firm for the operation of the Website and for its communications are located, or host information, outside the Republic of Paraguay. In particular:

  • the Website uses fonts and an embedded map supplied by a third-party provider; accordingly, when the page loads, the user’s browser transmits certain technical information, such as the IP address, to that provider;
  • the WhatsApp contact button redirects the user to a third-party messaging service, which processes communications in accordance with its own terms of service and privacy policy; and
  • inquiries and applications sent by email are received and stored on the email, hosting and data storage services engaged by the Firm, whose servers may be located abroad.

In such cases, the Firm endeavors to ensure that its providers offer adequate safeguards for the protection of personal data, in accordance with applicable law.

08Cookies and Browsing Data

The Website may use cookies or similar technologies necessary for its operation and, where applicable, to obtain statistical information on its use and improve the browsing experience.

Users may configure their browser to reject or delete cookies. Disabling certain cookies may, however, affect some features of the Website.

09Data Retention and Security

The Firm will retain personal data for as long as necessary to fulfill the purposes for which it was collected and, thereafter, for such periods as may be required to comply with legal obligations or to protect its rights.

The Firm implements reasonable technical and organizational measures designed to protect personal data against loss, alteration, and unauthorized access, disclosure or use. Notwithstanding the foregoing, no method of transmission or storage of information over the Internet can guarantee absolute security.

10Data Subject Rights

Data subjects may request access to their personal data and, where applicable, its updating, rectification or erasure, in accordance with applicable law.

11Minors

The Website is not directed at persons under eighteen (18) years of age, and the Firm does not knowingly collect personal data from minors through the Website. If a parent, guardian or legal representative becomes aware that a minor has provided personal data to the Firm through the Website without their authorization, they may request its erasure by writing to info@vpa.com.py.

12Amendments

The Firm may amend or update this Privacy Policy as necessary. The current version will be available at all times on the Website, indicating the date of its last update.

13Governing Law and Jurisdiction

This Privacy Policy is governed by the laws of the Republic of Paraguay. Any dispute arising out of its interpretation, application or performance shall be submitted to the jurisdiction of the ordinary courts of the city of Asunción, Republic of Paraguay, with express waiver of any other forum or jurisdiction that might otherwise apply.
